We just started using MailChimp because it seems to be the only one that offers a free account for small or new users. A. Whether a seller or forwarder is a “sender” or “initiator” depends on the facts. So deciding if the CAN-SPAM Act applies to a commercial “forward-to-a-friend” message often depends on whether the seller has offered to pay the forwarder or give the forwarder some other benefit. For example, if the seller offers money, coupons, discounts, awards, additional entries in a sweepstakes, or the like in exchange for forwarding a message, the seller may be responsible for compliance. With the exception of their email templates (which aren’t the most inspiring), everything about Constant Contact is generally quite good. Unlike other email marketing tools, there are no bells or whistles with Constant Contact. You’re probably not going to be blown away by any of their features, but equally, there’s nothing too underwhelming either.
Again, “newsletters” are annoying to all of us. Who wants to read your “Memorial Day Newsletter”? (Even your mom is only glancing at it and that’s just to be polite because she loves you). However, emails with your voice, philosophy and insights that the recipient actually appreciates and is interested in? That’s an entirely different beast. That is what we are going for here. I think this email also makes quite a brilliant use of responsive design. The colors are bright, and it's not too hard to scroll and click -- notice the CTAs are large enough for me to hit with my thumbs. Also, the mobile email actually has features that make sense for recipients who are on their mobile device. If an email advertises or promotes the goods, services, or websites of more than one marketer, there’s a straightforward method for determining who’s responsible for the duties the CAN-SPAM Act imposes on “senders” of commercial email. Marketers whose goods, services, or websites are advertised or promoted in a message can designate one of the marketers as the “sender” for purposes of CAN-SPAM compliance as long as the designated sender:
Honor opt-out requests promptly. Any opt-out mechanism you offer must be able to process opt-out requests for at least 30 days after you send your message. The only exception is that you may transfer the addresses to a company you’ve hired to help you comply with the CAN-SPAM Act.
