The CAN-SPAM Act of 2003 was passed by Congress as a direct response to the growing number of complaints over spam emails. Congress determined that the US government was showing an increased interest in the regulation of commercial electronic mail nationally, that those who send commercial emails should not mislead recipients over the source or content of them, and that all recipients of such emails have a right to decline them. The act authorizes a US $16,000 penalty per violation for spamming each individual recipient. However, it does not ban spam emailing outright, but imposes laws on using deceptive marketing methods through headings which are "materially false or misleading". In addition there are conditions which email marketers must meet in terms of their format, their content and labeling. As a result, many commercial email marketers within the United States utilize a service or special software to ensure compliance with the act. A variety of older systems exist that do not ensure compliance with the act. To comply with the act's regulation of commercial email, services also typically require users to authenticate their return address and include a valid physical address, provide a one-click unsubscribe feature, and prohibit importing lists of purchased addresses that may not have given valid permission.

Here is the ONLY example I’ve seen of someone doing this on their blog, and it comes from Brennan Dunn who I’ve had the pleasure of getting to know personally in the last year. I’ll let the pictures do the talking then I’ll summarize… That’s step 1, and here’s step 2… And then here’s the result: Pretty awesome right? If you look closely, you can even see that the point after the traffic settles down after the third spike is higher than the “valleys” after the first two spikes. I don’t know of any tools to recommend that make this easy (though I plan to have my developer create a plugin for WordPress when I get around to it in the future). Free floor plan layout software can be either 2D or 3D and will allow you to sketch your floor plan or virtually tour your design, respectively. Free 3D house design software is very useful for projects that involve planning where plumbing or wiring should be placed.
Where they can improve: The automation editor lacks a workflow view, so isn’t the most intuitive to use. List management isn’t the best, either – it doesn’t remove duplicates and lists are kept isolated from another. It also has one of the strictest acceptable use policies, and isn’t ideal if your business deals with affiliate marketing, healthcare products, real estate or novelty products. And it’s certainly not the cheapest provider out there – surprising, given its popularity (which just goes to show the power of great marketing!). Note – we’ve noticed that emails from MailChimp tend to go to Gmail’s Promotions folder.
What we liked: SendInBlue’s prices are hard to beat, with their lowest plan starting at $25/month for up to 40,000 subscribers. And the fact that you get so much for the little you pay is incredible. For instance, we love that you can send transactional emails (invoices, password resets) straight from the tool. Automations are also pretty advanced, with options to build campaigns based on email clicks, opens, and web visits.
Delivra – Delivra is an email marketing automation platform designed to make sure the right messages get to the right people at the right moment. The service features automation, a drag-and-drop editor, multichannel drip campaigns, custom and responsive email templates, triggered mailings, and analytics. Overall, MailChimp remains a solid choice of email marketing platform for small business owners with a small and slow-growing list, or who are just getting started with email marketing and want to test the benefits before opting for a paid solution. But if you’re serious about growing your email list and aim to push quickly past that 2,000 subscriber mark, you’re better off starting from the outset on a paid platform with more comprehensive capabilities.
